RECOMMENDATION(S)

recommendation

 

1.  That Bylaw 28/2017 be amended by deleting it in its entirety and replacing it with the version of Bylaw 28/2017 provided as the document entitled "Policing Committee Bylaw 28/2017 (amendments incorporated)", provided as an attachment to the May 23, 2017 agenda report entitled "Bylaw 28/2017 Policing Committee Bylaw - 2nd and 3rd Reading".

 

2.  That Bylaw 28/2017 as amended, be read a second time.

 

3.  That Bylaw 28/2017 be read a third and final time. 

 

4.  That Administration undertake all necessary actions to enable the Committee to commence its role and exercise its authorities effective January 1, 2018.

 

5.  That Administration add $10,300 into the 2017 Operating Budget, funded from the Stabilzation Reserve, in order to add a .56 fte, effective July 1, 2017, to the Policing Services department to provide the necessary administrative support required for the new Policing Committee, including preparatory work in advance of the Committee's start-up and that ongoing funding for this position shall be built into the future operating budgets.

 

6.   That $10,000 be added to the 2017 Operating Budget, funded from the Stabilization Reserve, to support start-up costs such as recruitment of respective committee members and preparation of committee orientation materials and that an annual and ongoing $20,000 budget shall be built into future operating budgets.

 

7.   That Administration review City Council Policy C-PS-02, Policing Services, to ensure that the policy is in-line with the new policing committee oversight processes established in the Bylaw and bring back any recommended changes to Council by the end of Q2 2018.

PURPOSE OF REPORT

 

Council has directed Administration to draft and present a Bylaw for the establishment of a formal Policing Committee. This is a continuation of the original report provided to Council on May 1, 2017 related to the Policing Committee Bylaw. 

 

COUNCIL DIRECTION

 

On May 1, 2017 Council passed the following motion:

That Bylaw 28/207, be read a first time.

 

On November 28, 2016 Council passed the following motion:

 

(C236-2016)

That Administration use: the guiding principles as outlined in the October 17, 2016 agenda report entitled “Policing Committee Update Report” as amended; and the approved Alberta Policing Oversight Standards for Policing Committees when released, when drafting the Policing Committee Bylaw for Council consideration.

 

BACKGROUND AND DISCUSSION

 

On May 1, 2017, Administration presented and Council provided first reading on a proposed Policing Committee Bylaw that would formally establish a Policing Committee pursuant to the Alberta Police Act.

 

On May 15, 2017, Council debated and defeated a Council motion related to conducting public consultation related to this Bylaw.

 

Five notices of motion have been made by individual Councillors and Administration has provided background information on those motions in a separate document.

 

After the May 1, 2017 presentation, some typos were noticed in the proposed Bylaw that was given first reading. Administration has corrected those typos and provided a recommended motion to accept the changes. The new amended Bylaw with the corrections is shown on an attachment to this report. The specific changes can be viewed in a redline version provided as an attachment to this report. The originally proposed bylaw with typos is shown in attachment provided with this report.

 

The previously distributed agenda report presented on May 1, 2017 has been added as an attachment entitled Previously Distributed May 1, 2017 Agenda Report.
