1.                     That the City Manager be authorized to negotiate purchase of lands for the Community Branch Library as per recommendation 1 contained within the Confidential Administrative Report entitled “St. Albert Branch Library - Proposed Location”, provided as an attachment to the March 13, 2017 Standing Committee of the Whole Agenda Report entitled “Land Matter”.

 

2.                     That $971,785 of the anticipated 2016 Budget surplus be allocated to the purchase of the AFRRCS Emergency Radio System.

PURPOSE OF REPORT

 

To pass motions on matters that were discussed at the March 13 Standing Committee of the Whole (SCW) meeting and voted on at the March 13, 2017 Special Council Meeting.

 

COUNCIL DIRECTION

 

At the Special Council Meeting held on March 13, 2017, Council voted on the following motions:

 

(AR-17-182)

(AR-17-183)

That $971,785 of the anticipated 2016 Budget surplus be allocated to the purchase of the AFRRCS Emergency Radio System.

 

BACKGROUND AND DISCUSSION

 

A Special Council Meeting was held immediately after the SCW Meeting on March 13, 2017.  During the in camera portion of the SCW Meeting, discussions were held on "Land Matter #1" and an "Emergent Personnel Matter".  At the beginning of the Special Council Meeting, two new items were added to the agenda; consideration of motions that were outcomes of the in camera discussions on  "Land Matter #1" and the "Emergent Personnel Matter".

 

However, section 194(5) of the Municipal Government Act states: "No matter other than that stated in the notice calling the special council meeting may be transacted at the meeting unless the whole council is present at the meeting and the council agrees to deal with the matter in question."  As Councillor MacKay was not in attendance at the Special Council Meeting, the conditions necessary to be able to add items to the agenda were not met.  Therefore, the decisions of Council on these matters added to the agenda are not valid.

 

These matters have already been discussed by SCW, and although the votes that were held on these resolutions were not valid, they received unanimous approval at that time.  Therefore, Administration has recommended that these resolutions be addressed via the Consent Agenda.

 

STAKEHOLDER COMMUNICATIONS OR ENGAGEMENT

Following the Special Council Meeting on March 13, 2017, the results of Council's votes were announced to the public and to affected personnel .  The decisions were also reported in the Gazette.

There are no further implications other than those presented during the confidential discussions held on March 13, 2017.

ALTERNATIVES AND IMPLICATIONS CONSIDERED

 

Do not pass Recommendation 1.

If this motion is not passed, the City Manager would not have Council's authorization to negotiate the puchase of lands for the Community Branch Library.  This would seem to be contrary to Council's intent on March 13 when considering this motion.  This change in direction would need to be communicated to the public and any actions by Administration that have already occurred to carry out this direction would need to undone.

 

Do not pass Recommendation 2.

If this motion is not passed, the funding would not be available to purchase the AFRRCS Emergency Radio System. This would seem to be contrary to Council's intent on March 13 when considering this motion.  This change in direction would need to be communicated to the public and affected personnel, and any actions by Administration that have already occurred to carry out this direction would need to undone.

 

Since March 13, when this motion was presumed to have been passed, Administration has been working within very tight timelines to accomplish required tasks for year end, and to prepare financial reports for submission to the provincial government.  If this resolution is not passed, it will be very challenging for Administration to accomplish everything required in the time remaining.  Also, a subsequent motion or motions would need to be passed to allocate the funding if it is not approved to be expended to purchase the AFRRCS Emergency Radio System.
