That the following individuals be appointed as members of both the Composite Assessment Review Board (the "CARB") and the Local Assessment Review Board (the "LARB") established under Bylaw 15/2020 the Assessment Review Boards Bylaw, effective immediately, for terms of appointment indicted in parentheses next to their names:

 

-                     Randy Mann  (term expires:  Dec 31, 2022)

-                     Elena Sacluti  (term expires:  Dec 31, 2022)

-                     Mitch Stolarchuk  (term expires: Dec 31, 2023)

-                     John Sugden  (term expires: Dec 31, 2020)

-                     Normand Therrien  (term expires: Dec 31, 2023)

 

That Normand Therrien be appointed Chair of the CARB and Randy Mann be appointed Chair of the LARB, both effective immediately, each for a term as Chair expiring at 11:59 PM on December 31, 2021.

The Municipal Government Act requires Council to establish Assessment Review Boards and to appoint members and a Chair for each board.

 

BACKGROUND AND DISCUSSION

 

Bylaw 15/2020, the Assessment Review Boards Bylaw, establishes both a CARB and a LARB as required by the Municipal Government Act.  It is both legally permissible and common practice to appoint a person to both of these boards, which is what Administration is now recommending to Council.  When a complaint against assessment is received (if it is not resolved through discussion with the Assessment Department) it is heard by either a one-person or a three-person panel of either the LARB or the CARB depending on the nature of the complaint.  The role of the Chair is to select members to sit on the panels that hear complaints.  The Municipal Government Act requires Council to appoint the Chairs of both the CARB and the LARB.  The ARB Bylaw stipulates that the term of a Chair cannot exceed two years, so Administration is recommending that the two Chair appointments made now be for a term expiring at the end of 2021 in order to comply with the bylaw and also eventually align the Chair appointments with Council's normal timelines for when external agency appointments come up for renewal.

 

The five persons being recommended for appointments were all appointed last fall under the former ARB Bylaw, and all have indicated their willingness to continue as members of the new CARB and LARB established under the new ARB Bylaw, for terms identical to their former terms of appointment.  Two of those persons also indicated that they were willing to take on the role of Chair of a board, if so appointed by Council;  the other three declined that opportunity.  We therefore have the number of members and the number of Chairs required at this time, without the need for Council to review additional applications beyond the ones received and reviewed last fall.
