That Ken Benson be appointed as a member of the Subdivision & Development Appeal Board for a term beginning on February 24, 2026, and ending on December 31, 2027.

SUMMARY

 

Legislative Services received a resignation from a Board Member of the Subdivision & Development Appeal Board; therefore this report is brought forward to fill this vacancy.

 

ALIGNMENT TO COUNCIL DIRECTION OR MANDATORY STATUTORY PROVISION

 

Section 9 of the Subdivision & Development Appeal Board Bylaw 20/1995 states that:

 

In the event of a vacancy, Council may, by resolution, appoint a new member to serve for the remainder of the vacating member's term.

 

Civic Agency Policy C-CC-12 states:

 

3. If a member of the civic agency is unable to complete the term of office as required, that member shall be replaced by Council appointment, provided that at least five months are left in the member’s term of office.

 

BACKGROUND AND DISCUSSION

 

On February 3, 2026, one member of the Subdivision & Development Appeal Board submitted their resignation effective immediately with term ending December 31, 2027. The recommendation brings forward one new appointment who will be completing the term of the previous member as indicated above.

By appointing applicants to Committee/Board vacancies, Council is ensuring that the membership requirements outlined in the various Committee/Board Bylaws are fulfilled. The SDAB Bylaw 20/1995 provides that the SDAB “shall consist of seven (7) members.”

IMPACTS OF ALTERNATIVES CONSIDERED

 

If Council chooses not to fill the vacancy on the Subdivision & Development Appeal Board (SDAB), the Board will consist of 6 public members, which is contrary to the requirements of the SDAB Bylaw.
