PURPOSE OF REPORT
This report discusses the timeline to set a public hearing for Bylaw 47/2021 (Jensen Lakes Area Structure Plan Amendment) and Bylaw 48/2021 (Jensen Lakes 12th Redistricting).
ALIGNMENT TO PRIORITIES IN COUNCIL’S STRATEGIC PLAN
St. Albert Council Strategic Plan
Strategic Priority #3: Building a Transportation Network: Integrated transportation system.
Increase the efficient and effective movement of people and goods in St. Albert through integrated modal planning and regional cooperation.
Strategic Priority #5: Housing: Enhance housing options.
Facilitate an increase in the variety of housing types in St. Albert to response to market demands and accommodate the diverse needs of residents.

Processing and coordination of the approval of Statutory plans and amendments, subdivisions and condominium applications.
ALIGNMENT TO MANDATORY STATUTORY PROVISION
Section 692(1) of the Municipal Government Act requires that the subject matter of this report go to Council, and that a public hearing be held before giving second reading to the bylaw.
Bylaw 47/2021 - EMRB Referral
The Municipal Government Act, Part 17.1, outlines the regulations and compliance to the Edmonton Metropolitan Regional Board (EMRB). As such, Ministerial Order No. MSD:088/20 Regional Evaluation Framework, states that the ASP amendment must be referred to the EMRB due to the following submission criteria under Sections 4.3(c)(i), and 4.3(j)(i), (ii), and (iii) of the Regional Evaluation Framework (REF) dated September 2020:
4.3(c)(i) The proposed statutory plan amendment requires the extension or upgrading of regional infrastructure not identified in or consistent with the Growth Plan or would result in a change to the boundaries of an area structure plan, intermunicipal development plan, or urban service area where the boundary change results in an increase in area of more than 8 hectares.
4.3(j)(i) The boundaries of the proposed amendment to the statutory plan include a Park-and-Ride.
4.3(j)(ii) The boundaries of the proposed amendment to the statutory plan are within 0.4 km of a Planned LRT line.
4.3(j)(iii) The boundaries of the proposed amendment to the statutory plan are within 0.4 km of a TOD Centre as identified on Schedule 2: Edmonton Metropolitan Regional Structure to 2044 in the EMRGP or as delineated more specifically by a municipality through a Council approved mechanism.
First reading was held on February 22, 2022. The file was referred to the EMRB on February 23, 2022, and a recommendation of approval by the EMRB was given on March 21, 2022. The appeal period lasted until April 18, 2022. No appeals were lodged during this time.
Bylaw 48/2021 - Redistricting
Bylaw 48/2021 cannot proceed until a decision is made on the Area Structure Plan Amendment.
BACKGROUND AND DISCUSSION
Bylaw 47/2021 - Jensen Lakes Area Structure Plan Amendment
Bylaw 47/2021 received first reading on February 22, 2022. On February 23, 2022 Bylaw 47/2021 was referred to the Edmonton Metropolitan Region Board for decision. On March 21, 2022, the EMRB recommended approval of the plan. The appeal period for this decision lasts until April 18, 2022. No appeals have been lodged at the time of writing this report. It is anticipated that a public hearing could proceed in May, and Administration is requesting that a public hearing date be set for May 16, 2022.
Bylaw 48/2021 - Jensen Lakes 12th Redistricting
Bylaw 48/2021 received first reading on February 22, 2022. The redistricting file could not proceed until a decision has been made on the Area Structure Plan Amendment (Bylaw 47/2021).Administration is requesting that a public hearing date be set for May 16, 2022, after the ASP Amendment.
STAKEHOLDER COMMUNICATIONS OR ENGAGEMENT
Public Consultation was part of both of the bylaws and will be detailed in the public hearing agenda reports. The public hearing date will be advertised on the City website, and in City Lights.
