PURPOSE OF REPORT

 

This report discusses a proposed amendment to Schedule A of the Land Use Bylaw (LUB), which would see Joyal Park in Jensen Lakes Area Structure Plan redistricted from Public and Private Service (PS) to Public Park (P). The proposed amendment requires a public hearing and Council’s approval, as per the requirements in the Municipal Government Act (MGA).

ALIGNMENT TO COUNCIL DIRECTION OR MANDATORY STATUTORY PROVISION

 

Section 692(1) of the Municipal Government Act requires that the subject matter of this report go to Council, and that a public hearing be held before giving second reading to the bylaw.

This amendment conforms with the Municipal Development Plan-Flourish, policy:

11.4.10. Require the development of school sites and parks to be consistent with City objectives and standards regarding recreation and parks services.

As per the policy above, the City-led redistricting will separate the land use district for the public park from the school sites. The City-owned park is utilized for public park use. The existing school site’s land use district will remain as Public and Private Service.

 

BACKGROUND AND DISCUSSION

 

Administration is proposing to amend the Land Use Bylaw 9/2005, Schedule A, by redistricting Joyal Park in Jensen Lakes neighbourhood. The proposed redistricting separates the Land Use Bylaw districts for the public park from the school sites.

Joyal Park is located in the southeast portion of the Jensen Lakes neighbourhood. Joyal Park has an area of 2.59 hectares (Fig 1). Joyal Park and the school sites for Joseph M. Demko School and Sister Alphonse Academy are currently districted Public and Private Service (PS). Standard practice within St. Albert is to district schools as Public and Private Service (PS), and district park sites as Public Park(P). Redistricting Joyal Park to Public Park (P) supports the stated purpose of the district by providing parks along with complementary facilities throughout the City for the purpose of public recreation. As Joyal Park is currently subdivided from the school site, the process is done to clearly articulate the park site from the school site. Joyal Park will be retained by the City of St. Albert as a public amenity separate from the adjacent school sites. The park and school sites are developed, and have been operational since 2019. No physical changes to the park or school sites are being proposed through this redistricting. Access to the proposed redistricting area will remain as currently provided from Joyal Way to the north and south of the park site.

The proposed redistricting is consistent with the existing subdivision and the Jensen Lakes Area Structure Plan, which shows the subject area designated as Park. The Municipal Development Plan shows this area as Neighbourhoods, which is also consistent with the proposed redistricting.

A Park is a permitted use in the Public Park (P) district. Discretionary land uses in this district include recreation and facility type uses.

 

STAKEHOLDER COMMUNICATIONS OR ENGAGEMENT

 

The proposed Land Use Bylaw amendment was circulated on April 29, 2022, with comments due on May 16, 2022, to internal departments, external referral agencies, and mailed to 213 property owners within 100-meter radius. No objections were received.

A notification sign about the redistricting was placed on Jensen Lakes Boulevard across the street from Joseph M. Demko School.

Following first reading by Council, information about the public hearing will be posted on the City website. The public hearing will be advertised in CityLights on July 27 and August 3, 2022. A notification letter about the public hearing will be mailed to property owners within a 100-meter radius of the site.

The public hearing is proposed to be scheduled for September 19, 2022.
